Terms of Sale

Article 1 — Objet et champ d'application

These Terms of Sale (hereinafter "Terms of Sale") govern all sales concluded between Talseume, a brand operated by BOUZANGA Mes reves, entrepreneur individuel (EI) sous le nom commercial Dikenga design, whose registered office is located at 44c Allée Robillard, 93320 Les Pavillons-sous-Bois — registered with the Bobigny Trade and Companies Register (RCS) under number 519 495 758, hereinafter referred to as "the Seller", and any adult natural person acting in a non-professional capacity ("the Customer" or "the Consumer") making a purchase on the talseume.com website.

Any order constitutes full, complete, and unreserved acceptance of these Terms of Sale by the Customer. The Seller reserves the right to amend the Terms of Sale at any time; the applicable version is the one in effect on the date the order is validated, as archived by the Seller. The Terms of Sale are permanently accessible on the website.

Article 2 — Legal Capacity of the Customer

The Customer declares that they are at least 18 ans and to have full legal capacity to place an order on the website. A minor may only place an order with the authorization and under the responsibility of an adult legal representative, who agrees to comply with these Terms of Sale. Any order placed by a minor without such authorization may be cancelled by the Seller.

Article 2 bis — Produits

The essential characteristics of the products offered (composition, size, color, price, photos) are described on each product page. Images are provided for guidance purposes only : despite our efforts to ensure their accuracy, slight color variations may appear depending on your screen's calibration.

Products are offered subject to available stock. In the event of unavailability after an order has been placed, the Customer is informed without delay and receives a full refund.

Article 3 — Prix

Prices are stated in euros (€), excluding shipping costs. The Seller benefits from the VAT exemption scheme (article 293 B of the French General Tax Code) : TVA non applicable, art. 293 B du CGI. The prices displayed are therefore net, exclusive of VAT.

Shipping costs are specified to the Customer before final order validation, in the cart summary.

Talseume reserves the right to modify its prices at any time; orders will nevertheless be invoiced on the basis of the price in effect at the time of validation.

Article 4 — Commande

Pour passer commande, le Client :

• selects their items and adds them to the cart,
• renseigne ses informations de livraison et de facturation,
• choisit son mode de livraison et de paiement,
• definitively validates their order by clicking "Pay", which constitutes express acceptance of the Terms of Sale and formation of the contract.

A confirmation email summarizing the items ordered, the total amount, and the delivery address is sent without delay to the address provided. The Seller reserves the right to refuse or cancel any order for a legitimate reason (prior dispute, suspicion of fraud, stock shortage); the Customer is then fully refunded.

Article 5 — Paiement

Payment is due at the time of order. The accepted payment methods are :

• cartes bancaires (Visa, Mastercard, American Express),
• Apple Pay,
• Klarna — payment in 3 interest-free installments, subject to acceptance by Klarna.

Transactions are secured via Stripe, a PCI-DSS Level 1 certified provider. Banking data neither transits through nor is stored on Talseume's servers.

The order is only definitively recorded once payment has been effectively confirmed by the banking institution. In the event of payment rejection, the order is automatically cancelled.

Article 6 — Livraison

Orders are prepared and shipped within 1 to 2 business days from payment confirmation (excluding sales periods, drops, or public holidays). The delivery times below run from the date of shipment :

These timeframes are indicative and provided subject to product availability and carrier-related contingencies. In accordance with article L.216-1 of the French Consumer Code, in the event of a delay exceeding 30 jours, the Customer may cancel the order and obtain a full refund within 14 days.

For deliveries outside the European Union, the Customer is solely responsible for the payment of any customs duties, local taxes, and customs clearance fees.

Article 7 — Right of Withdrawal

In accordance with articles L.221-18 to L.221-28 of the French Consumer Code, the Customer has a period of 14 jours calendaires from receipt of the last item in their order to exercise their right of withdrawal, without having to justify their decision or bear any penalties other than return shipping costs.

To exercise this right, the Customer sends an email to [email protected] stating their name, order number, and intention to withdraw. They then have 14 days to return the items, new, unworn, unwashed, with tags attached, in their original packaging, to the address that will be provided to them.

Return shipping costs remain the Customer's responsibility, except in the case of a defective or non-conforming product. The refund is issued within 14 days of receipt and inspection of the items, using the payment method used when placing the order.

The right of withdrawal does not apply to personalized items, sealed items, or items that have been unsealed and cannot be returned for hygiene reasons.

Article 8 — Legal Warranties

All Talseume products benefit from :

• de la statutory warranty of conformity provided for under articles L.217-3 to L.217-17 of the French Consumer Code. This warranty covers defects of conformity existing at the time of delivery for 2 ans. The Customer may, at their discretion, request the repair or replacement of the item, unless the cost is manifestly disproportionate;
• de la warranty against hidden defects provided for under articles 1641 to 1649 of the French Civil Code, allowing the Customer to obtain a full or partial refund in the event of a hidden defect rendering the product unfit for use.

Any complaint must be addressed to [email protected] accompanied by photos and the order number. Defects resulting from abnormal use, care not in accordance with the recommendations, or modification of the product are not covered.

Article 9 — Service client

Our customer service team is available by email [email protected], Monday to Friday, with a response time of 24 to 48 business hours.

Article 10 — Mediation

In accordance with articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the Customer may have free recourse to a consumer mediator and/or to the European Online Dispute Resolution platform : ec.europa.eu/consumers/odr.

Article 11 — Intellectual Property

The purchase of a Talseume product confers no intellectual property rights over the trademarks, designs, logos, photographs, or related content. Any reproduction, modification, or commercial exploitation is prohibited without the Seller's prior written consent.

Article 12 — Personal Data

The data collected as part of an order is processed in accordance with our Privacy Policy, dans le respect du RGPD.

Article 13 — Force majeure

The Seller cannot be held liable for non-performance or delayed performance resulting from a case of force majeure as defined by French case law.

Article 14 — Droit applicable

These Terms of Sale are governed by French law. In the event of a dispute, and after a prior attempt at amicable resolution, the French courts shall have sole jurisdiction, unless otherwise mandatorily provided in favor of the Consumer.
